As per Government of India, Ministry of Home Affairs order No. 11034/31/2008-IS-VI dated 01/12/2009 & Corrigendum dated 04/12/2009, National Investigation Agency (NIA) took over the investigation of FIR No. 81/2006 dated 03/03/2006 of Nadakuvu Police Station, Kozhikode district (The case was transferred to CB CID, SIG-III on 13/06/2006 vide CBCID Crime No.183/CR/S-III/06 . During the investigation sections 120 (B), 124(A), 153(A), 324 r/w 34 IPC and sections 15(a), 15 (a) (ii) of UA (P) Act were added) and re-registered the case as RC-06/2009/NIA/DLI on 08/12/2009 at NIA Police Station, New Delhi under sections 120 (B), 124(A), 153(A), 324 r/w 34 of IPC, sections 3, 4, 5 of Explosive Substances Act and sections 15(a), 15 (a) (I) of UA(P) Act.

Summary of Allegations

On 03/03/2006, at about 12:30 PM information was received by the police that bombs have been placed at KSRTC Bus Stand, Kozhikode City and at the new bus stand. The police teams reached the spot. At about 12:45 PM, when the police party was near Sagar Hotel, on Mavoor Road, an explosion took place at the KSRTC Bus Stand [the eastern side of Sagar Hotel (KSRTC compound)] and the party saw garbage waste, plastic and cloth pieces flying all around the places in all directions.

Present Status

Investigation and trial of the case has been completed. Judgement was pronounced by Hon’ble NIA Special Court, Ernakulam on 11 August, 2011. 02 accused persons were convicted to imprisonment for life and 02 other accused persons were acquitted. Appeal against the acquittal of above two accused has been filed before the Hon’ble High Court of Kerala on 31/10/2011 by NIA. The appeal is pending before the Hon’ble High court. The convicted accused also filed appeals against their conviction before the Hon’ble High Court of Kerala and the same are also pending.NBW, LOC & RN are pending against the 2 absconding accused.

Judgement pronounced on 11.08.2011 and 02 accused persons were convicted and 02 were acquitted.
