Activities of CPI (Maoist)

As per GOI, MHA Order No. F. No. 11011/21/2012-IS.IV dated 29.3.2012 National Investigation Agency Headquarters at New Delhi took over the investigation of FIR No. 138/2012 of Police Station Jorasanko, Kolkata, West Bengal and re-registered the case on 12.04.2012 at Police Station NIA, New Delhi as case No. RC-01/2012/NIA-DLI under Sections 120B, 121, 121A, 122 of the Indian Penal Code (IPC), read with Section 25-1(A) of the Arms Act 1959, Section - 5 of the Explosive Substances Act, 1908 and Sections 18, 20, 40(1)(b)(c) of the Unlawful Activities (Prevention) Act, 1967 as amended by Act 35 of 2008, against accused persons Sadula Ramakrishna (A-1), Deepak Kumar (A-2), Sukumar Mondal (A-3), Sambhu Charan Pal (A-4), Bapi Mudi (A-5) and other persons.

Summary of Allegations

The accused persons entered into a criminal conspiracy to wage war against the Government of India, being members of the banned organisation Communist Party of India (Maoist). In furtherance to their conspiracy, they collected explosive substances, prohibited arms and ammunitions and huge amount of money in a concealed manner from different parts of India including but not limited to Kolkata and Mumbai. Further, in pursuance to the said criminal conspiracy, the accused Sadula Ramakrishna A-1 and Dipak Kumar A-2 with the assistance of Sukumar Mondal A-3, Sambhu Charan Pal A-4, Bapi Mudi A-5 in Kolkata and A-1 with the assistance of Asimkumar Bhattacharya (A-6), Dinesh Kailash Wankhede (A-7), Paru Arjun Patel (A-8), Suman Mangalsingh Gawade (A-9) in Mumbai used to send the above mentioned items procured for assembling arms and ammunitions and such ready-made purchased items to fictitious addresses at Raipur, Chhattisgarh through different transport companies in Kolkata and Mumbai.

Present Status of Investigation

After completion of investigation, chargesheet has been filed on 23.08.12 against 05 accused persons and supplementary chargesheet on 27.12.2012 against 04 accused persons before the Hon’ble NIA Special Court, Kolkata. The framing of charges is pending in the NIA Special Court at Kolkata.

Five top senior functionaries of CPI(Maoist) are still absconding in the case and have been declared as proclaimed offenders Proclamation for attachment of property u/s 83 CrPC was also issued against the absconders by the Hon’ble Court.
