Binanipuram SIMI Activities

As per Government of India, Ministry of Home Affairs order No. 11034/31/2009–IS-VI dated 24/12/2009 National Investigation Agency (NIA) took over the investigation of FIR No. 159/2006 dated 15/08/2006 of Binanipuram, Police Station, Ernakulum District, Kerala and re-registered the case on 21/01/2010 at NIA Police Station, New Delhi as RC-03/2010/NIA/ DLI under sections 120(B), 124(A) of IPC and sections 10 & 13 (i) (b) of UA (P) Act.

Summary of Allegations

On 15/08/2006, a secret meeting of the Students Islamic Movement of India (SIMI), a banned organization, was held at Happy Auditorium, Panayikulam. The meeting of SIMI was anti-Government, seditious, inflammatory, provocative and capable of creating religious animosity. Accordingly, a case was registered at Binanipuram Police Station.

Present Status

After completion of investigation, and collecting sufficient evidence against all the 17 accused, a charge sheet was filed in the trial court on 30/12/2010.

On 25.11.2015 the Hon’ble NIA Special Court, Ernakulam pronounced judgment whereby 5 accused persons who were conducting the meeting were convicted, while 11 accused who had participated in the meeting were acquitted. On 30.11.2015 the Hon’ble Court sentenced A-1 and A-2 for 14 years Rigorous Imprisonment and a fine of Rs.60,000/- while A-3, A-4 and A-5 were sentenced to 12 years Rigorous Imprisonment and fine of Rs.55,000/-.

The 5 convicted accused filed appeal against conviction and NIA has filed appeal against acquittal of 11 accused before the Hon’ble High Court of Kerala, Ernakulam. Appeals are pending.
