Activities of LeT - Edakkad
As per Government of India, Ministry of Home Affairs Order No11034/31/2009-IS-VI dated 24/12/2009 National Investigation Agency (NIA) took over the investigation of FIR No 356/2008 of Edakkad Police Station, Kannur district and re-registered the case on
21/01/2010 at Police Station NIA, Delhi as RC-02/2010/NIA/ DLI under sections 120(B), 121, 121(A), 122, 123, 124(A), 212, 465, 471 r/w 34 of IPC and under sections 13(2), 16, 18, 19, 38, 39 & 40 of UA (P) Act .
Summary of Allegations
On 18/10/2008, information was received that one K.V.Abdul Jalil along with some unknown persons were aiding and assisting LeT (a terrorist organization) and for this purpose they were recruiting some youth from Kerala for Jehadi training in Pakistan in
order to wage war against the Government of India. It was further alleged that out of these, five recruited youth engaged in subversive activities in Kupwara District of Jammu & Kashmir and four were killed in an encounter with security forces. The case was
registered against 24 accused persons.
Present Status
Chargesheet was filed by Kerala Police against 22 accused persons on 16/01/2009 and Supplementary Charge sheet against 01 accused person was filed on 17/08/2009 before the Hon’ble Additional Chief Judicial Magistrate, Thalassery, Kerala. NIA filed supplementary
charge sheet on 13/01/2011 against 01 accused person before the Hon’ble NIA Special Court, Ernakulam, Kerala. Trial of the case has been completed against 18 charged sheeted accused. Judgement was pronounced on 01 October, 2013 by the Hon’ble Special Court
for Trial of NIA Cases, Ernakulam convicting 13 accused persons and acquitting 05 accused persons. On 04/11/2013, 13 convicted persons filed appeals against their conviction before the Hon’ble High Court of Kerala, Ernakulam which were admitted by the Hon’ble
Court on 15/11/2013. On 10/01/2014 NIA filed an appeal before the Hon’ble High Court of Kerala, Ernakulam for not convicting accused under provisions of section 122 IPC. Trial of 02 absconding accused is pending before the Hon’ble Special Court for Trial of
NIA Cases. NBW, LOC & RN are pending against absconding accused Mohd Sabir @ Ayub while NBW & RN are pending against Wali @ Abdul Aziz.
