As per GOI, MHA order No. 17011/50/2009-IS-VI dated 01/06/2009 NIA took over the investigation of FIR No 03/2009 of Diyungmukh Police Station, Assam, and re- registered the case on 05/06/2009 at PS NIA, New Delhi as Case RC-02/2009/NIA/DLI Under section 120B, 121 & 121A of IPC and Section 25 (1B) (a) of Arms Act.

Summary of Allegations

On 11/02/2009, Assam Police, on the basis of source information, that some persons/workers of NC Hills Autonomous Council were going to hand over huge amount of money to DHD (J) extremists somewhere between Haflong to Diyungmukh for the purpose of procuring arms and ammunition and for promoting terrorist activities with a view to wage war against the state, stopped and checked a Scorpio vehicle bearing registration number AS-08-5133 in which Golon Daulagpu, Member, Autonomous Council, NC Hills and Jibangshu Paul were travelling. Cash amounting to Rs. 32, 11,000/- was recovered from the possession of Jibangshu Paul. During investigation, 5 nos. of M–16 Rifles, 3 nos. of SLR Rifles and other weapons were also recovered.

Present Status

Charge sheet was filed on 18/10/2010 against 16 accused persons before the Hon’ble NIA Special Court, Assam at Guwahati. At the time of framing charge, accused Sameer Ahmed pleaded guilty and an order of conviction was passed. The accused was sentenced to undergo rigorous imprisonment for 3 years with a fine of Rs500/- vide order dated 01/03/2013. Charges have been framed against accused Golon Daulagupu and Jibangshu Paul. Other accused persons were discharged from this case vide order dt 01.08.2013, on the ground that the accused are facing similar charges in Spl NIA case no.01/2009. The Trial of the case continued in the Special NIA Court, Assam at Guwahati with case RC-01/2009/NIA-DLI w. e. f. 01/08/2013 as joint trial.
