As per Government of India, Ministry of Home Affairs order No. 17011/50/2009-IS-VI dated 01/06/2009,National Investigation Agency (NIA) took over the investigation of FIR No. 170/2009 of Basistha Police Station, Assam and re- registered the case on 05/06/2009 at NIA Police Station, New Delhi as Case No. RC-01/2009/NIA/DLI Under section 120B, 121 & 121A of IPC and Section 25 (1-B) (A) of Arms Act.

Summary of Allegations

On 01/04/2009, Assam Police apprehended two persons namely Phojendra Hojai and Babul Kemprai and recovered cash amount of Rs. 1 Crore along with two pistol and letter from their possession. The money had been siphoned from the development funds allotted to the NC Hills Council in connivance with the contractors and other Government servants and was being sent to Dima Halem Daogah (Jewel),a terrorist outfit for procurement of arms and ammunition for waging war against the State. During investigation, 08 numbers of M-16 Rifle made in Singapore, one 9 mm pistol Baretta, 12 walkie- talkie sets with chargers and one telescope Bushnell were also recovered.

Present Status

Charge sheet was filed on 17/11/2009 against 14 accused persons and supplementary charge sheet against one accused person was filed on 09/02/2011 before the Hon’ble NIA Special Court, Assam at Guwahati. At the time of framing charge, accused Sameer Ahmed pleaded guilty and an order of conviction was passed. The accused was sentenced to undergo rigorous imprisonment for 3 years with a fine of Rs.1000/- vide order dated 10/08/2012. The trial of the case continued in the Special NIA Court, Assam at Guwahati with RC-02/2009/NIA-DLI w. e. f. 01/08/2013 as joint trial, on day-to-day basis as per the mandate of law enshrined in Sec 19 of the NIA Act,2008. Prosecution evidence continued.
